1. Who provides the membership?

FORM Golf Performance is a joint golf coaching and golf strength and conditioning venture operated by: Bradley Harris, trading as Brad Harris Golf. Joshua Cottingham, trading as COTT Coaching. FORM Golf Performance is a trading name and is not currently a separate limited company or incorporated legal entity.

Our correspondence address is: FORM Golf Performance Lewes Golf Club Chapel Hill Lewes BN7 2BB Contact: contact@formgolf.co.uk In these terms, “we”, “us” and “FORM Golf” refer to the two sole traders operating the FORM Golf Performance venture.

A one-off joining fee of £125 applies to each new membership. The joining fee covers the initial joint assessment and consultation with Brad and Josh, goal setting, programme planning and relevant app or coaching setup. The membership features and allocations are those displayed for the selected tier at the time of purchase.

Any additional benefits or changes will be communicated to members. A standalone joint physical assessment may also be purchased separately without joining a membership. Its price and booking details will be shown separately.

3. Membership commitment and billing

All memberships have an initial minimum commitment of three months. After the initial three-month commitment, the membership continues on a monthly rolling basis until cancelled. Membership fees are collected monthly in advance using the payment method provided at sign-up.

Payments are processed through Stripe. By subscribing, you authorise the recurring monthly payment for your selected membership. The membership fee reserves access to the services and allocations included in your selected tier.

It is not calculated solely by reference to the number of sessions attended in a particular month. You are responsible for keeping your payment details up to date and ensuring that payments can be collected. If a payment fails, we may contact you to arrange payment.

We may temporarily suspend membership access or bookings where payment remains outstanding.

4. Joining fee

The one-off £125 joining fee covers the initial joint assessment, consultation, goal setting, programme planning and setup associated with starting your membership. Once these services have been delivered, the joining fee is generally non-refundable, subject always to your statutory consumer rights. Where you enter into the membership online or otherwise at a distance, you may have a statutory 14-day cancellation right.

If you expressly request that services begin during that period, you may be required to pay a proportionate amount for services already provided. Your cancellation rights will be explained at sign-up.

5. Monthly session allocations

Your membership includes the golf tuition and strength and conditioning sessions listed for your selected tier. Sessions are allocated monthly and: Must be booked in advance. Are for the named member only.

Cannot be transferred to another person or member. Cannot be exchanged between golf tuition and strength and conditioning. Cannot be exchanged for cash or a refund.

Are subject to coach and facility availability. Unused sessions do not automatically roll over into the following month. You may request to carry an unused session into the next month.

Any carry-over is at FORM Golf’s discretion and must be approved by us in advance. Where approved, the carried-over session must be used by the end of the following month. It will expire after that point if unused.

We may ask for reasonable notice when you request a carry-over so that we can manage coach availability and session allocations.

6. Booking, rearranging and cancelling sessions

All sessions must be booked in advance through the relevant booking arrangements provided by FORM Golf. We require at least 24 hours’ notice to cancel or rearrange an individual session. If you cancel with less than 24 hours’ notice, or fail to attend a booked session without notice, the session will normally be counted as used and deducted from your monthly allocation.

We may waive this requirement in exceptional circumstances at our discretion. If Brad or Josh needs to cancel a session, we will arrange a replacement booking. Where necessary, we will extend the relevant session allocation or membership period so that you do not lose the session as a result of our cancellation.

The same 24-hour cancellation policy applies to standalone physical assessments.

7. Additional sessions

Members may purchase additional golf tuition or strength and conditioning sessions outside their monthly allocation. Additional sessions are charged at the applicable standalone member rate, which may be higher than the effective per-session cost of upgrading to a higher membership tier. Additional sessions are subject to availability and must be paid for in accordance with the booking or payment instructions provided.

8. Studio hire

Memberships include a monthly studio hire allocation as shown in the membership table. Studio hire: Must be booked separately through the FORM Golf / Foremost booking arrangements. Is subject to availability and the studio's booking rules.

Is intended for the member’s own practice or recreational use, including practice with friends. Cannot be used to provide coaching, tuition, personal training or other commercial instruction to another person. Cannot be transferred or sold to another person.

Recurring weekly studio slots may be available at the same time each week, subject to availability and booking confirmation. Members must use the studio and equipment responsibly, follow any safety instructions and leave the facility in an appropriate condition. Studio hire hours are monthly allocations and do not automatically roll over.

Any exception must be agreed in advance by FORM Golf.

9. Upgrading or downgrading your membership

You may request to upgrade or downgrade your membership at any time. A membership change takes effect immediately once processed. Where a change is made part-way through a billing period, Stripe will calculate and apply the relevant payment adjustment in accordance with the payment arrangements shown at the point of change.

This may include a pro-rata charge or credit. Your session allocations and studio hire allowance will be adjusted to reflect the new membership tier from the effective date. We will confirm how any allocations already used or booked are treated when processing the change.

10. Membership freezes

You may request a temporary membership freeze due to injury, illness or another exceptional circumstance. All freezes are subject to discussion and approval by Brad and Josh. A freeze: May be approved for a maximum of one month.

Pauses membership payments during the approved period. Pauses monthly session and studio hire allocations. Extends the initial three-month minimum commitment by the length of the approved freeze.

Delays the next payment and allocation cycle until the membership resumes. A freeze is not automatic and must be agreed before it takes effect. We may ask for reasonable information about the circumstances of the request so that we can consider it appropriately.

11. Cancelling your membership

You may request cancellation through your member account, where the cancellation facility is available, or by emailing contact@formgolf.co.uk. During the initial three-month minimum commitment, cancellation will not normally end your payment obligations before the minimum commitment has been completed. You remain responsible for the agreed membership payments for the remainder of that commitment, subject to any statutory cancellation rights or an agreed exception.

After the initial minimum commitment, you may cancel at any time. Your membership will remain active until the end of the current paid billing period and no further monthly payment will be taken after that period. Any cancellation request should be made before the next scheduled payment date to avoid the next payment being collected.

Cancelling your membership does not automatically cancel any separate bookings or outstanding payments for additional services. These terms do not limit any statutory cancellation rights you may have.

12. Injury, illness and changes in circumstances

If you experience an injury, illness or other change that affects your ability to participate, please contact us as soon as possible. We can discuss suitable adjustments, a temporary freeze or alternative arrangements. Any change to your membership or payment schedule must be agreed with FORM Golf.

We will consider requests reasonably and take account of the circumstances and services already provided. Our coaching and strength and conditioning services are not a substitute for medical diagnosis or treatment. You should seek appropriate medical advice where necessary.

13. Member responsibilities and safety

You agree to: Provide accurate and relevant information about your health, injuries and ability to participate. Inform us of any relevant changes to your health or circumstances. Follow reasonable coaching, safety and facility instructions.

Use equipment and facilities responsibly. Treat coaches, staff and other members respectfully. Attend booked sessions on time.

Keep your login details and account access secure. Not share, copy or redistribute coaching materials, programmes or member-only content without permission. We may restrict access to a session or activity if we reasonably believe participation would create a safety risk to you or another person.

14. Coaching programmes and digital content

Training programmes, exercise descriptions, coaching notes, videos and other materials supplied as part of your membership are intended for your personal use. You must not reproduce, distribute, sell or commercially use these materials without our written permission. Access to third-party platforms, including Everfit, may be subject to the relevant provider’s own terms and conditions.

We may make reasonable changes to the delivery or format of coaching services where necessary, provided that we do not materially remove the core services included in your membership without appropriate notice or agreement.

15. Coach availability and service changes

We will make reasonable efforts to deliver the services included in your membership. Session times and studio access are subject to availability. We may need to change a booking due to coach illness, facility issues, maintenance or other circumstances outside our reasonable control.

Where we cancel a session, we will offer a replacement booking and, where necessary, extend the relevant allocation or membership period. If a significant change affects the services included in your membership, we will communicate this to you and discuss appropriate arrangements.

16. Liability and participation

You are responsible for providing accurate information relevant to your participation and following reasonable safety instructions. Our services are designed to support golf performance, physical development and general fitness. We do not provide medical diagnosis, treatment or rehabilitation services.

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or any other liability that cannot legally be excluded. Your statutory consumer rights remain unaffected.

17. Privacy and personal information

We collect and use personal information to administer memberships and provide golf coaching, physical assessments and strength and conditioning services. This may include contact details, payment information, golf performance information, videos and health or injury information. Brad and Josh both have access to relevant customer and coaching records as part of the joint operation of FORM Golf.

Further information about how we collect, use, store and protect your information is set out in our Privacy Policy.

18. Changes to these terms

We may update these terms where necessary to reflect changes to our services, business arrangements or legal obligations. Where a change materially affects your membership or contractual rights, we will provide reasonable notice and explain the change. We will not use a change to these terms to remove rights that you have already acquired under applicable law.

19. Complaints and contact

If you have a concern about your membership, sessions or the services provided, please contact us so that we can try to resolve the matter. FORM Golf Performance Email: contact@formgolf.co.uk Address: Lewes Golf Club, Chapel Hill, Lewes, BN7 2BB
